Website Ownership: The website, as well as all related rights, is the property of Throwback Sneakers in its entirety. Any reproduction, in whole or in part, is prohibited without the express prior authorization of Throwback Sneakers.
- ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF SALE
The customer acknowledges having read, prior to placing an order, the general terms and conditions of sale set out on this page. These general terms and conditions of sale govern the contractual relationship between Throwback Sneakers and its customer. They shall prevail over any other conditions contained in any other document, unless prior, express, and written waiver by Throwback Sneakers. These general terms and conditions of sale may be modified at any time by Throwback Sneakers, without prior notice.
- ORDER
Automatic registration systems are considered proof of the nature and content of the order. Throwback Sneakers confirms acceptance of the order to the customer at the email address provided by the customer. The sale will be concluded upon validation by Throwback Sneakers of payment for the order, i.e., the date of payment validation for orders paid online by credit card (PayPal, Visa, Mastercard, American Express, Aurore, Cofinoga, or 4 Etoiles) or the date of receipt of payment by bank transfer or check (contact us). Throwback Sneakers reserves the right to refuse or cancel any order from a customer with whom there is a dispute regarding the payment of a previous order.
- PRICE AND PAYMENT
PRICE AND PAYMENT:
All Orders are payable in euros, and payment for purchases is made online using a bank card or the Customer's PayPal account. The Buyer will be debited with the full amount indicated on the Order Summary on the day of the Order.
The price is expressed in euros, excluding taxes (excluding VAT). The price indicated on the product pages does not include shipping. The price indicated in the order confirmation is the final price, excluding taxes. This price includes the price of the products, handling, packaging, and storage costs, as well as shipping, insurance, and commissioning fees. Payment can be made either:
- By credit card (Carte Bleue, Visa, Mastercard);
- By PayPal account.
- By Apple Pay
- By bank transfer (contact us): the package will be shipped once the transfer is credited to the bank account.
Payments by check are not accepted.
- RETENTION OF TITLE CLAUSE
By express agreement, and in accordance with the provisions of the law of May 12, 1980, the products ordered remain the property of Throwback Sneakers until full payment of their price by the customer. In the event of non-performance of its obligations by the customer, regardless of the cause, Throwbacks Sneakers shall be entitled to demand the immediate return of the products at the customer's expense, risk, and peril.
- PRODUCT AVAILABILITY AND SHIPPING
The indication "in stock" means that the item is available at Throwback Sneakers at the time of ordering.
The indication "out of stock" means that the item is no longer available for sale.
For mainland France, Monaco, and Andorra, depending on the option chosen by the customer when ordering, delivery is made by La Poste, either by Colissimo or by registered Colissimo with the recipient's signature upon receipt.
For all other destinations, delivery will be made by La Poste via international Colissimo (with the recipient's signature upon receipt).
All packages shipped by Throwback Sneakers have a tracking number, which will be communicated to the customer upon shipment.
Orders are processed, prepared, and shipped, i.e., handed over to our carrier, within 24/48 hours from:
- Customer validation of payment when made by PayPal or online credit card transfer.
- Receipt of payments made by bank transfer.
Throwback Sneakers undertakes to take all necessary steps to ensure orders are delivered within 30 days of payment validation and receipt. The carrier, for its part, is contractually bound by Throwback Sneakers to deliver the order to the buyer's address provided by Throwback Sneakers.
To report any delivery issues, customers can use an online contact form and a phone number (+339.50.64.02.96) to contact Throwback Sneakers.
For deliveries outside mainland France, the customer agrees to pay all taxes due on the importation of the products, customs duties, value-added tax, and any other taxes due under the laws of the country where the order is received. Throwback Sneakers cannot be held responsible for the failure to pay taxes for which the customer is responsible.
Regardless of the delivery location, the package will be delivered to the recipient's address during the day. In case of absence, a delivery notice will be left at the delivery address. Any costs for re-delivery are the customer's responsibility. The customer is required to check the condition of the products upon receipt. In the event of damage, the customer must clearly state their concerns on the delivery slip and reiterate them to the carrier by registered letter with acknowledgment of receipt within three (3) days of delivery, in accordance with the provisions of Article L.133-3 of the French Commercial Code. The customer must also notify Throwback Sneakers by registered letter with acknowledgment of receipt of any damage due to transport within eight (14) days of receipt. No claims will be accepted for failure to comply with these formalities.
Throwback Sneakers will, in any event, be released from its obligation to deliver in the event of:
- the occurrence of a force majeure event such as war, riots, fire, strikes, accidents, and the impossibility of obtaining supplies,
- failure by the customer to fulfill any of its obligations (payment of the price, accuracy of the information provided by the customer such as the delivery address)
- LIMITATION OF LIABILITY
The information provided on the website (photographs, product sheets, prices, etc.) is provided for informational purposes only. Throwback Sneakers strives to ensure the accuracy of the information presented on the website. Any errors that may have occurred are purely accidental and will be corrected as quickly as possible.
- WITHDRAWAL
In accordance with the provisions of Articles L.221-18 et seq. of the French Consumer Code, the customer has 14 days from the date of receipt to return the product in its original packaging for replacement or refund. Returns are at the buyer's expense and will only be accepted if the product has not been unpacked or used. All returns must be preceded by a withdrawal number obtained through Throwbacksneakers (the address will be provided upon request). Otherwise, the package will be refused. Refunds will be issued within 30 days of the date on which the customer exercised their right of withdrawal (Article L.121-20-1 of the French Consumer Code).
- LEGAL INFORMATION
Personal information relating to the customer is essential for processing and delivering orders, issuing invoices, and issuing warranty contracts. Failure to provide this information will result in the order not being validated. In accordance with the French Data Protection Act (French Data Protection Act), the processing of personal information relating to customers has been declared to the French National Commission for Information Technology and Civil Liberties (CNIL). The customer has the right (Article 34 of the Act of January 6, 1978) to access, modify, rectify, and delete their personal data, which they may exercise with Throwback Sneakers.
- APPLICABLE LAW
All sales by Throwback Sneakers are subject to French law. In the event of a dispute, the Paris Courts shall have sole jurisdiction.
